chainjobs Terms of Service

Draft – to be reviewed by a lawyer before publication. Effective from: [DATE].

§1. General

  1. These Terms set out the rules for using the chainjobs website (the "Service").
  2. The Service is operated by Artur Bucki, ul. Południowa 6, 16-420 Raczki, Poland, tax ID (NIP) 8442387394, REGON 540570765 (the "Operator").
  3. These Terms constitute the terms of service referred to in Article 8 of the Polish Act of 18 July 2002 on Providing Services by Electronic Means and the terms and conditions within the meaning of Article 14 of Regulation (EU) 2022/2065 (the Digital Services Act, "DSA").
  4. These Terms are available free of charge in the Service before registration, in a form that allows them to be downloaded, stored and printed.

§2. Definitions

  • User – a natural person, legal person or organisational unit using the Service.
  • Client – a User who publishes a Listing for a job.
  • Freelancer – a User who offers services in their Profile or applies to a Listing.
  • Consumer – a natural person entering into a legal transaction not directly related to their business or professional activity.
  • Business – a User acting in connection with their business or professional activity.
  • Listing – a job description published by a Client.
  • Service Listing – a description of services a Freelancer offers, published in the Services section.
  • Chat – private messages between Users in the Service, either about an application to a Listing or started directly from a Profile or Service Listing.
  • Profile – a User's public page, including their skills, portfolio and preferred payment methods.
  • User Agreement – an agreement for the performance of a job concluded directly between a Client and a Freelancer.

§3. Nature of the Service

  1. The Service is a job board. It allows Users to publish Listings and Profiles and to get in touch with each other.
  2. The Operator is not a party to any User Agreement, does not act as an intermediary or agent for either party, and is not responsible for its performance.
  3. The Operator does not receive, hold, transfer or exchange money or crypto-assets due under a User Agreement. It does not maintain accounts, wallets or escrow services for Users.
  4. The Operator does not provide crypto-asset services within the meaning of Regulation (EU) 2023/1114 (MiCA) or payment services.
  5. The form, currency and method of payment for a job are agreed solely by the parties to the User Agreement. Information about preferred payment methods in a Profile or Listing is for information only.
  6. Offers sent in the Chat (scope, price, deadline, milestones) and their acceptance are a record of what the Users agreed between themselves. The Operator is not a party to them and does not enforce them.

§4. Account and registration

  1. Browsing Listings and Profiles does not require an account. Publishing content, applying to Listings and leaving reviews require an account.
  2. An account may be created by a person aged 18 or over with full legal capacity, or by an entity acting through an authorised representative.
  3. The account agreement is concluded free of charge, for an indefinite period, when registration is confirmed. A User may terminate it at any time by deleting their account in the settings. The Profile is cleared immediately and the remaining data is deleted within 30 days.
  4. When registering, a User states whether they act as a Business or as an individual. This information is visible to other Users on the Profile and Listings. The User must update it promptly if their status changes.
  5. Users must provide true and up-to-date information and must not share their account with third parties. One person may hold one account unless the Operator agrees otherwise.

§5. Technical requirements and security

  1. To use the Service you need a device with internet access, an up-to-date browser with JavaScript and cookies enabled, and an active email address.
  2. Using online services carries typical risks such as malware, phishing or account takeover. Users should use a strong password and not click links from unknown people.
  3. The Operator never asks for recovery phrases (seed phrases), private keys or passwords to crypto wallets. Any such request, including one impersonating the Operator, is a scam.

§6. Listings, Profiles and prohibited content

  1. Users are responsible for the content they publish and declare that they hold the rights to it.
  2. A Listing must concern a specific job for a service or deliverable and contain a fair description of its scope. Listings remain visible for 30 days. 2a. A Service Listing must describe services the Freelancer provides personally and remains visible for 60 days; the Freelancer may pause and renew it. Rules on prohibited content (point 3) and on crypto-assets (§7) apply to Service Listings and Chat messages in the same way as to Listings. 2b. Public Listings and Service Listings may be shared automatically on chainjobs channels (for example Discord or Telegram), showing the title, price, accepted payment methods and a link.
  3. It is prohibited to publish content that:
    1. is unlawful, including content inciting violence, hatred or discrimination;
    2. infringes third-party rights, in particular copyright, trademarks and personal rights;
    3. is misleading, including fake job offers and impersonation of other people or companies;
    4. is pornographic or concerns sexual services;
    5. is spam, chain messages or advertising unrelated to a specific job.

§7. Crypto-assets and payments between Users

  1. If the parties to a User Agreement agree on payment in crypto-assets, they make it directly between themselves, at their own risk, using their own wallets.
  2. It is prohibited to use the Service to:
    1. offer, buy, sell or exchange crypto-assets, including exchange and OTC services;
    2. collect money or crypto-assets from other Users, including token presales, fundraising, "investments" and pyramid schemes;
    3. promote token issuances or give investment advice;
    4. launder money, finance terrorism or evade sanctions, including jobs that involve moving other people's funds ("money mules");
    5. gain access to other people's wallets or private keys.
  3. Jobs for crypto projects (e.g. development, design, writing, community management, marketing) are allowed as long as the service itself does not breach paragraph 2.
  4. The Operator does not verify transactions between Users, does not confirm payments and does not resolve payment disputes.
  5. Crypto-assets carry risks, including price volatility, sending funds to the wrong address or network, and irreversibility of transactions. The Operator recommends using a separate wallet for payments, because a wallet address lets anyone trace its history and balance.
  6. Each User is solely responsible for their taxes on the remuneration they receive, including remuneration in crypto-assets, under the laws of their country. The Operator is not a tax remitter and does not give tax advice.

§8. Reporting content and moderation

  1. Anyone, including people without an account, can report content they consider illegal or contrary to these Terms using the "Report" link next to the content or by email to the Operator.
  2. A report should include: an explanation of why the content is illegal, an indication of the content, the reporter's name and email address (except for reports concerning child sexual abuse) and a statement of good faith.
  3. The Operator handles reports without undue delay, diligently and objectively, and informs the reporter of its decision.
  4. The Operator may hide content or suspend an account for 30 days if the content or the User's conduct breaches the law or these Terms. Decisions are made by a person.
  5. The Operator informs the User of each such decision in their account, with a statement of reasons: what was done, on what facts, whether automated tools were used, which provision of the Terms or the law was breached, and how to appeal.
  6. A User may appeal a decision within 6 months by emailing the Operator. Appeals are handled by a person, not solely by an automated system. Users may also lodge a complaint with a Digital Services Coordinator (in Poland: the President of the Office of Electronic Communications, UKE) or go to court.
  7. The Operator may suspend, for a reasonable period, the account of a User who frequently publishes manifestly illegal content, and the processing of reports from a person who frequently submits manifestly unfounded reports.
  8. If the Operator becomes aware of information giving rise to a suspicion of a criminal offence involving a threat to the life or safety of persons, it promptly informs the law enforcement authorities.

§9. Point of contact

The single point of contact for Users and for the authorities of Member States, the European Commission and the European Board for Digital Services is the email address shown in the footer of the Service. Contact is possible in English and Polish.

§10. Reviews

  1. A review may only be left by two Users who actually worked together – a Freelancer whose application to a Listing was accepted and the author of that Listing, or two Users who confirmed a collaboration started in the Chat – and only after both sides confirm in the Service that the work has been completed. Each side may review the other once.
  2. It is prohibited to post fake reviews, buy reviews, review oneself, or demand the removal of a negative review in exchange for a benefit.
  3. The Operator does not edit reviews. It may hide a review only for the reasons set out in §6 and §8.

§11. Ranking

  1. Listings are displayed newest first, except Promoted listings (once promotion is available), which are shown above the others for the period paid for. Service Listings are displayed newest first. Profiles in the freelancer directory are displayed with Users marked "Open to work" first, then most recently updated first.
  2. Promoted listings are clearly labelled "Promoted". Promotion is the only paid factor that affects ranking.
  3. Users can filter results by category, payment method and search phrase.

§12. Credits and Paid Services

  1. During the launch period all services in the Service are free of charge. The Operator may introduce paid services under the rules below, after giving notice in accordance with §16.
  2. Once introduced, some services in the Service are paid with credits: publishing a Listing (a User's first Listing is free), promoting a Listing for 7 days and applying to a Listing. Current prices in credits are shown on the Credits page before each purchase.
  3. Credits can be bought for USDC sent from the User's own wallet to the Operator's address shown on the Credits page. One credit costs 1 USDC. Credits are added after the payment is confirmed on the blockchain. The Operator may introduce other payment methods.
  4. Credits are a prepaid balance for the Operator's own services only. They cannot be withdrawn, exchanged back into money or crypto-assets, sold or transferred to another User, and they are not crypto-assets or electronic money.
  5. Purchased credits are valid for 12 months from purchase. Free credits (such as the welcome bonus) may be withdrawn if the account is used to abuse the Service.
  6. If a Listing the User applied to is removed by moderation as a scam, the Operator returns the credits spent on that application.
  7. The Operator checks paying addresses against international sanctions lists and may refuse a payment from a listed address; such a payment is returned where the law allows it.
  8. While the Credits page shows "test mode", payments use a test network and have no monetary value.

§13. Right of withdrawal

  1. A Consumer may withdraw from an agreement for services in the Service within 14 days of its conclusion without giving a reason, by sending a statement to the Operator's email address. Unused credits are refunded to the wallet they were paid from.
  2. Spending credits on a service (publishing, promotion or an application) means requesting immediate performance; the right of withdrawal expires once that service has been fully performed.
  3. This section also applies to a natural person running a business where the agreement is not of a professional nature for them.

§14. Complaints

  1. Complaints about the operation of the Service can be sent to the Operator's email address, describing the problem and giving the account's email address.
  2. The Operator handles complaints within 14 days and replies to the email address the complaint was sent from.
  3. The Operator does not handle complaints about the performance of User Agreements.
  4. Consumers may use out-of-court dispute resolution, such as the assistance of a local consumer ombudsman.

§15. Liability

  1. The Operator is not liable for content published by Users if it has no knowledge of its illegal nature and, upon obtaining such knowledge, promptly disables access to it.
  2. The Operator is not liable for the performance of User Agreements, including payment, quality of work, deadlines, losses resulting from crypto-asset price changes or incorrectly executed transfers.
  3. These limitations do not apply to damage caused intentionally and do not limit Consumers' rights under mandatory provisions of law.

§16. Changes to the Terms

  1. The Operator may change these Terms for important reasons, in particular changes in the law, the scope of services or security requirements.
  2. The Operator gives notice of changes by email and in the Service at least 30 days before they take effect. A User who does not accept the changes may delete their account before that date.
  3. A shorter period is possible where required by law, a decision of an authority, or to prevent fraud.

§17. Final provisions

  1. These Terms are governed by Polish law. This choice of law does not deprive a Consumer of the protection of mandatory provisions of the law of their country of habitual residence.
  2. Disputes with Businesses are resolved by the court having jurisdiction over the Operator's registered office.
